Meeting Minutes November 10, 1987

The annual meeting of Loma Topkie Property Owners Association was held on Tuesday, November 10, 1987 at the home of Herb and Betty Martin.

Those in attendance were:
Lee and Olin Philips
Elizabeth and Jack Welsh
Herb and Betty Martin

Kel and Madge LeMaster were unable to attend. Madge has sold their home in the subdivision and gave us her verbal request for resignation as President. The group expressed their regret that Madge will be leaving us.

Due to Madge's absence, Betty Martin, Secretary, called the meeting to order. A letter from John J. Avignone was read; it enclosed the annual fee.

Minutes of the last annual meeting were read by Betty Martin. There was a motion made by Elizabeth Welsh, seconded by Lee Philips, that the minutes be approved as amended. Motion passed. Treasurer's report was given stating there is $821.46 in the savings account. The annual dues of $50.00 per parcel were paid by each member of the association.

Herb mentioned the chip sealing of the subdivision road, which was discussed at last year's meeting. It was the general feeling that inasmuch as the subdivision road is a dedicated road we write to Yavapai County to request they seal-coat it next spring. If they are not agreeable to this, then we possibly can offer to pay half of the cost. After the first of the year the Secretary will write to the County regarding this.

Herb Martin made the suggestion that we request the Arizona Department of Transportation (ADOT) to erect "No Parking at any time" signs on the hill portion coming into the subdivision on Topkie Drive. A motion was made by Lee Philips and seconded by Elizabeth Welsh that the Secretary write to ADOT to see if this can be accomplished. Herb Martin is to draw up a petition to be signed by the property owners to be sent with the letter to ADOT. Motion passed. Due to the fact that it is only a two-lane road, it is proving to be a hazardous condition.

The subject of the electrical line that APS installed on Topkie Drive to service the Hogan house was brought up. It was noted that the electrical line is not in conduit as required by the Arizona Corporation Commission. Olin Philips stated that we have no responsibility as APS installed the lines without discussing the matter with the Loma Topkie property owners. Mr. Hogan's property is not in the subdivision. However, it was felt that our Association should write to Arizona Corporation Commission stating that we are aware that the lines are not in conduit, thus putting them on notice for any possible future problem. Motion was made by Lee Philips, seconded by Elizabeth Welsh, that the Secretary send certified letter, return receipt requested, to Arizona Corporation Commission as above. Motion passed.

Herb Martin mentioned that a charge could be made to Hogan for damage and upkeep of the road, but inasmuch as it is a dedicated road, Hogan is not legally liable. When Mr. Hogan first broke ground to make his entrance on Topkie Drive, the county attorney in Prescott told Olin Philips that Mr. Hogan has the right to have this entrance, and this is where the matter stands.

Betty Martin reported that Lot #4 (LeMaster) had been sold to Mrs. Anna May Cory of Tacoma, Washington. We understand she and her son will be occupying the property. When it is possible, the secretary will furnish Mrs. Cory with a copy of our deed restrictions, by-laws, and a copy of these minutes with the thought that she will become a member of our association. Mrs. Cory takes possession of the property, we understand, November 23, 1987.

Betty Martin made motion that Herb Martin be president for one term (two years), seconded by Olin H. Philips. Motion passed.

Lee Philips made motion that Herb Martin and Jack Welsh join Elizabeth Welsh on the architectural committee, seconded by Olin Philips. Motion passed.

There being no further business, Olin made motion, seconded by Elizabeth Welsh, that meeting be adjourned - time 5:15.
